1. WHO IS THE CONTROLLER OF YOUR DATA TREATMENT?

The controller for the data processing relating to the different processes regarding the management of our users, clients, or suppliers is HOTEL BERSOCA (hereinafter, THE CONTROLLER), with address for these purposes at Avinguda Jaume I 217, 12560 Benicàssim (Castellón), and contact email: bersoca@hotelbersoca.com.

2. WHAT TYPE OF DATA DO WE HAVE ABOUT YOU AND HOW HAVE WE OBTAINED IT?

The categories of personal data that the CONTROLLER processes regarding its clients and suppliers are:

  • Identification data.
  • Postal and/or electronic addresses.
  • Commercial information.
  • Transaction data.
  • Bank details (if the user wishes to direct debit the payment).

All the aforementioned data have been obtained either directly from you through the submission of a contact form or the presentation of a commercial offer, contractual proposal, etc., or through your company by providing us with the identification data and other information necessary to carry out the object of the contractual relationship between the parties. It will be an obligation of yours or your company to provide us with the updated data in case of modification.

3. FOR WHAT PURPOSE DO WE PROCESS YOUR DATA?

On behalf of the CONTROLLER, we process the data provided by the interested parties in order to manage different activities derived from specific procedures carried out in terms of service provision, sales, after-sales service, supplier management, service quality, etc. In this way, we will use your data to carry out some of the following actions:

  • Sending the information requested through the contact form on our website or any other means of contact with our company.
  • Providing our clients with information about products and services of interest to them.
  • Carrying out the administrative, fiscal, and accounting management of our clients and/or suppliers.

We are not going to elaborate commercial profiles based on the information provided and, consequently, we will not take automated decisions about you based on a commercial profile.

4. HOW LONG WILL WE KEEP YOUR DATA?

The personal data provided by the user for the contracting of products and services will be processed for the duration of the contractual relationship (which will begin at the time of the formalization of the Contract and will end after its termination).

Likewise, the data will be kept for the time necessary to comply with the purpose for which they were collected and to determine the possible liabilities that could derive from it, in addition to the periods established in the applicable legal regulations on archives and documentation.

5. WHAT IS THE LEGAL BASIS FOR THE PROCESSING OF YOUR DATA?

The legitimacy for the processing of your data is based on the consents obtained from the user, that derived from the use of digital platforms, the contracting of products or services, and the regulations applicable at any given time.

The consents of the users are obtained both at the time of user registration and in the different contracts or requests made within the digital platform, and can be modified at any time by the user through the exercise of their rights.

The processing may also be based, in the case of clients with contracts in force, on the legitimate interests of the CONTROLLER for the supply of products and the provision of own services, loyalty actions, profiling to offer products or services similar to the one contracted, and to communicate this data to third companies for purely administrative management for purposes necessary for the provision of the service, fraud prevention, debt reclamation, and collection.

Within the legitimate interest, the processing of user data for the management of security and access control of the supporting information systems is included.

If for the fulfillment of any management of the contract or specific request it is necessary for the user to provide personal data of individuals other than the holder, the user must inform them previously and expressly of the content of this policy and obtain their prior consent for the processing of their data.

For registration as a user in the digital platforms of the CONTROLLER, the declaration of legal age is required. Therefore, you declare and guarantee with your registration that you are of legal age. In any case, the CONTROLLER is exonerated from the data processing carried out on minors without the consent of their parents or guardians.

6. TO WHICH RECIPIENTS WILL YOUR DATA BE COMMUNICATED?

In the case of contracts, the data necessary to manage network access will be communicated to HOTEL BERSOCA and will be incorporated into a file under its responsibility, to which those determined by legislation at any time may have access.

The CONTROLLER in turn works with third-party service providers, such as sales channels, administrative support, telephone service, banks, recovery companies, marketing and advertising, auditing, and others who, in certain cases, may access your data with the necessary guarantees for the purposes of the processing.

In the event of non-payment by the client for its services, the CONTROLLER may communicate this to the entities responsible for creditworthiness and credit files in compliance with applicable regulations. It may also transfer the data to the competent entities, authorities, and bodies in compliance with corresponding legal and fiscal obligations.

The personal data of these clients may be communicated to the bodies in charge of protecting vulnerable consumers for the purposes of implementing the measures contemplated in RD 897/2017, which regulates the figure of the vulnerable consumer, as well as to any other Administration for the purpose legally determined.

7. WHAT ARE YOUR RIGHTS AS AN AFFECTED OR INTERESTED PARTY?

Anyone has the right to obtain confirmation as to whether or not we at the CONTROLLER are processing personal data concerning them.

Specifically, interested parties can exercise the following rights:

  • Access and Portability: Request access to their personal data, as well as receive them in a common and machine-readable format if the processing is carried out by electronic means.
  • Rectification: Request the correction of inaccurate or incomplete data.
  • Erasure: Request the deletion of their data when, among other reasons, they are no longer necessary for the purposes they were collected.
  • Restriction of processing: Request the reservation or restriction of the processing of their data in certain circumstances.
  • Objection: Object to the processing of their data for reasons related to their particular situation. The CONTROLLER will stop processing the data, except for compelling legitimate grounds, or the exercise or defense of possible claims.
  • Withdrawal of consent: Withdraw the consents granted at any time, without affecting the lawfulness of the processing prior to its withdrawal.

To exercise any of these rights or revoke your consent, the User can write to HOTEL BERSOCA using the contact details provided in Section 1, attaching a copy of their ID card or equivalent identification document.

In addition, you have the right to file a complaint with the Spanish Data Protection Agency (AEPD), especially if you have not obtained satisfaction in the exercise of your rights, through its website: www.aepd.es.

8. DATA PROTECTION OF WEBSITE USERS

In accordance with current Regulation (EU) 2016/679, the CONTROLLER informs that the personal data of website users will be processed for the processing activity indicated in each data collection form. Said processing will be covered by your own consent. By clicking the “SUBMIT” button, the User consents to the processing of their data by HOTEL BERSOCA.

Likewise, we inform you that unless there is a legal obligation or express consent on your part, the CONTROLLER will not transfer your data to third parties.

Similarly, the User is informed that at any time they can exercise the rights of access, rectification, or erasure of data, as well as have other recognized rights by notifying HOTEL BERSOCA at Avinguda Jaume I 217, 12560 Benicàssim (Castellón), or at the email: bersoca@hotelbersoca.com.

On the other hand, in accordance with Law 34/2002, of July 11 (LSSICE), the CONTROLLER undertakes not to send advertising via email without having previously obtained the express authorization of the recipient. The user may object to the sending of advertising by checking the corresponding box intended for this purpose.
